A Senior Advocate of Nigeria, Mr Femi Falana (SAN) has said that Lamido Sanusi, the dethroned Emir of Kano is not a member of the armed forces where insubordination is regarded as a crime.
Mr Falana said, "as a first class traditional ruler, if he had committed any offence known to law, it would have been brought to his attention and then he would have been expected to defend himself."
"What happened yesterday was a sharage, a situation whereby in a space of I think 5 minutes, the governor presided on a meeting where he accused the Emir of insubordination and disrespect to constituted authority, that is, himself, the governor. So the governor becomes the accuser, the prosecutor, the witness and the judge at the same time and without pretending to give the Emir the right of fair hearing. That is totally alien to our law, our jurisprudence, our constitution", Falana added.
He said, "it is specifically made clear by the constitution that no body shall be punished for an offence that is not defined by law. The Kano State governor has not pointed to any section of the law that the Emir Sanusi was alleged to have committed."
Falana said this On Tuesday on an edition of Sunrise on Channels Television, following the dethronement of the former Emir, Sanusi Lamido Sanusi II on Monday.
However, a source has told our reporters that the deposed Emir will seek a legal redress.
